This Automated License Plate Recognition ("ALPR") Usage and Privacy Policy (this "ALPR Policy") describes how Parkade, Inc. ("Parkade," "we," "us," or "our") uses license plate recognition technology at certain properties on the Parkade platform, as applicable and if specified in the applicable Service Order or Addendum with the relevant property owner or operator ("Customer"). This ALPR Policy is intended to comply with the requirements of applicable state and local laws governing the use of automated license plate recognition technology.
This ALPR Policy supplements, and should be read together with, Parkade's general Privacy Policy, available at https://parkade.com/privacy-policy, and, where applicable, the LPR-specific terms of any Service Order or Addendum between Parkade and a Customer governing the deployment of LPR technology at a specific property.
1. DEFINITIONS
"ALPR system" means the fixed cameras and related hardware and software, combined with computer algorithms, that Parkade uses to read and convert images of vehicle license plates into computer-readable data.
"ALPR information" or "LPR Data" means information or data collected through the use of an ALPR system, including license plate numbers, images, video, timestamps, and associated metadata such as location, direction of travel, and vehicle characteristics.
"ALPR operator" means Parkade, as the entity that operates the ALPR system described in this ALPR Policy.
"ALPR end-user" means a Customer or other person that accesses or uses LPR Data made available through an ALPR system operated by Parkade.
2. WHERE AND WHEN LPR TECHNOLOGY IS USED
Parkade deploys LPR technology only at properties where a Customer has specifically agreed to its installation and use under a Service Order or a separate LPR addendum. LPR technology is not used platform-wide, and its use at any given property does not imply its use at any other property. If you are unsure whether LPR technology is in use at a property where you park, you may contact us using the information in Section 11 below, or check for on-site signage, which Parkade requires as a condition of installation where applicable law requires it.
3. AUTHORIZED PURPOSES FOR ALPR USE
Where in use, LPR Data is collected and used for business needs related to parking. This may include, but is not limited to, the following:
- Automated gate access control, by matching a read license plate against a list of vehicles authorized for the property;
- Entry and exit tracking, including for automated billing, such as starting and stopping parking reservations based on entry and exit timestamps;
- General occupancy data collection for the property;
- Parking enforcement, including identifying unauthorized parking, overstays, and vehicles not associated with an active reservation; and
- Security purposes, including identifying and notifying the Customer of a potential security concern (such as a pattern suggestive of an unauthorized entry attempt), investigating a specific security incident at the Customer's request, and maintaining a banned-vehicle or repeat-violator list for the property.
LPR Data is not used for advertising or marketing purposes, and is not used to train, fine-tune, or otherwise improve any artificial intelligence or machine learning model other than the on-device plate-recognition function inherent to operating the ALPR system itself.
4. PERSONNEL AUTHORIZED TO ACCESS LPR DATA; TRAINING
Access to LPR Data is limited to the following categories of personnel, each of whom has a legitimate need to access LPR Data to operate, maintain, or support the ALPR system or to fulfill the authorized purposes described in Section 3: (a) Parkade-employed or Parkade-contracted personnel, including members of Parkade's engineering, operations, customer support, and trust and safety teams, and any third-party installer or technology provider engaged by Parkade to install, calibrate, service, or support the ALPR system; and (b) property administrated staff designated by the applicable Customer, which may include building managers, on-site or contracted security personnel, and other similar administrative roles reasonably requiring access to LPR Data for that property. Personnel and contractors described in clause (a) and Customers who designate property administrative staff as described in clause (b) are responsible for ensuring that individuals granted access receive appropriate training on this ALPR Policy, applicable law, and Parkade's data security practices before being granted access, and on an ongoing basis as this ALPR Policy or applicable law changes.
5. SYSTEM MONITORING AND SECURITY SAFEGUARDS
Parkade maintains reasonable administrative, technical, and physical safeguards designed to protect LPR Data from unauthorized access, destruction, use, modification, or disclosure, including access controls limiting LPR Data access to authorized personnel described in Section 4, encryption of LPR Data in transit and at rest where commercially reasonable, and periodic review of access logs to help ensure LPR Data is accessed and used only for the authorized purposes described in this ALPR Policy. Parkade periodically reviews its ALPR practices, including this ALPR Policy, to help ensure compliance with applicable law and to correct any identified data errors or accuracy issues in LPR Data.
6. ACCURACY OF LPR DATA
LPR technology, like any camera-based system, may occasionally produce an inaccurate or low-confidence read. Parkade's ALPR systems are configured so that a gate will not open, and no adverse action will be taken against a vehicle, based solely on an unverified or low-confidence read. Before any tow, citation, or other adverse enforcement action is initiated based in whole or in part on an LPR read, a human representative of the Customer or the Customer's enforcement vendor independently reviews and confirms the read, including by verifying the plate image against the vehicle, before that action is taken. If you believe LPR Data associated with your vehicle is inaccurate, you may contact us using the information in Section 11 below to request correction.
7. SHARING, SALE, AND TRANSFER OF LPR DATA
Parkade does not sell, rent, or trade LPR Data. Parkade does not voluntarily disclose LPR Data to any law enforcement agency or authority on its own initiative. Parkade may disclose LPR Data to law enforcement only at a Customer's specific written direction, limited to the data the Customer identifies and for the purpose the Customer specifies, or as required by valid legal process, in which case Parkade will, to the extent legally permitted, promptly notify the affected Customer before disclosing. Parkade may share LPR Data with its subprocessors and technology providers who support the ALPR system, provided they are bound by confidentiality and data protection obligations at least as protective as those described in this ALPR Policy. Parkade may also share LPR Data with the Customer for the property at which it was collected, consistent with the authorized purposes in Section 3.
8. RETENTION AND DESTRUCTION OF LPR DATA
Parkade retains LPR Data for as long as reasonably necessary to support the authorized purposes described in Section 3. Subject to the foregoing, LPR Data is retained indefinitely except in the following circumstances:
- Legal process or applicable law: LPR Data may be retained for a different period, including a shorter period, where required by a subpoena, court order, or other legal process, or where applicable state or local law imposes a specific maximum retention period for ALPR data; in any such case, Parkade will retain and delete LPR data in accordance with that legally required period.
Parkade's Chief Technology Officer serves as the official custodian responsible for implementing and overseeing compliance with this ALPR Policy, including the retention and destruction schedule described in this Section 8.
9. RELATIONSHIP TO CUSTOMER SERVICE ORDERS AND ADDENDA
Where Parkade and a Customer enter into a specific Service Order or addendum governing the deployment of LPR technology at a property (such as a pilot or permanent installation), the terms of that Service Order or addendum govern the specific deployment, and this ALPR Policy applies to the extent not inconsistent with those terms. In the event of any conflict between this ALPR Policy and a specific Service Order or addendum regarding LPR technology, the Service Order or addendum controls as to that property.
10. CHANGES TO THIS ALPR POLICY
Parkade may update this ALPR Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. When we do, we will post the updated ALPR Policy on this page and update the "Last Updated" date above. We encourage you to review this ALPR Policy periodically.
